GENERAL SALES CONDITIONS

R. Dyscar, S.L. has implanted the quality standars ISO 9001 as a referent in its activities, to stand out, if it is possible, its quality engagement. For this reason, in this document have been described the agreements and conditions about the goods supplies of R. Dyscar, S.L. after received the orders of the customers.

PRICES: The prices in our delivery notes and invoices are the same as those agreed in the offers and have not included I.V.A, and the taxes to apply.

DELIVERY: The delivery date will be done according to the agreed conditions for every order and it always will be approximate. The Company never will be responsible in any way of the delay when the reasons will be beyond the control of R. Dyscar, S.L.

GOODS TRANSPORT: The goods are considered property of the customer since the moment that them have left our store. being customer the responsible without matter which carrier company does the work and the terms of payment of the transport.

All the orders higher than 500 € will go with the transport prepaid around our national territory, except Ceuta, Melilla and Canary Islands when the transport always is paid by the customer. I some customers prefer to receive the goods by his carrier company, is him who must to do the manage it.

GOODS RECEPCION: We consider that al the goods are delivered according to the agreement when we do not receive any complain from the customer after five days of the delivery date. If a delivery is considered faulty by an undetectable problem (an intern problem that is not able to detect at a naked eye), and only will have a right to replace the good, or cancel the order done, and never have a right of other kind of compensation.

QUALITY: R. Dyscar, S.L. undertakes to inform the customer on all technical data of the product by the TDS and the precautions to be taken in its use, storage, labeling and packaging, etc.., using the data contained in the Safety Data Sheet. The customer must determine the suitability of products for the uses and applications provided, in accordance with the provisions of existing legislation (REACH and others) as well as the ability of mass production and application. as it will be a only a customer responsibility of the checking results.

To this end the customer must perform the appropriate tests for the intended uses including curing time and duration.

Also is an user responsibility to take the recommended precautions to protect persons against any risk that may arise from the handling and use of products.

R. Dyscar, S.L. declines specifically and responsibility produced by damages, incidental or resulting from the use of the products, including lost of gains.

DEVOLUTION: If the supplied goods are considered defective, checking will be done to make a change and its corresponding repeat or the cancelation of a supply.

When the customer put the goods back and alter the checking Is detected that it is faulty for a bad use, storage, conservation, etc, the goods will be returned to the customer with the corresponding debit in the invoice.

PAYMENT: Conditions of invoicing and payment must comply with current legislation

(Law16/2009 and3/2004, of November).

The payment terms showed in the invoice, explicitly authorizes to emit payment orders in the bank that is reflected in the invoice.

The goods are a property of R. Dyscar, S.L. until the payment is done.

In case of a delay in the payment of invoices. R. Dyscar, S.L. reserves the right to suspend the supply of new orders or business relationship, without renouncing to claim damages and interest for late payment.

WASTE: The holder of the final container waste, is the responsible of lhe correct environmental management in accordance with current regulations

OTHER INFORMATION: These general conditions of sale are understood and accepted by the purchaser. To resolve any interpretation and/or application of these, both parties, by mutual agreement, submit to the Courts and Tribunals of the city of Paracuellos de Jarama

DATA PROTECTION LAW: in accordance with the provisions of law 15/1999 on Protection of Personal Data. we inform you that your personal data will be included in an automated file under the responsibility of R. Dyscar, S.L., for power to meet the commitments derived from the relationship we have with vou. You can exercise your rights of access, cancellation, rectification and opposition by writing to the address Juan Ramon Jimenez,10 28860 Paracuellos de Jarama (Madrid). Until you tell us otherwise, we understand that your data has not been modified. you agree to notify any change and that we consent to use in order to retain the relationship between the parties.
